BizHost.co Content and Liability Disclaimer

1. Client Responsibility for Content
BizHost.co, a California-based company, provides web hosting services, including but not limited to shared hosting, dedicated servers, virtual private servers (VPS), and domain registration services. All content, materials, data, or information (collectively, "Content") uploaded, stored, or published on websites or services hosted by BizHost.co is created, owned, and controlled by the client or their authorized users ("Clients"). BizHost.co does not create, endorse, review, or monitor Client Content and is not responsible for its accuracy, legality, or appropriateness.
Clients are solely responsible for ensuring that their Content complies with all applicable federal, state, and local laws, including but not limited to copyright, trademark, privacy, defamation, and obscenity laws, as well as California-specific regulations such as the California Consumer Privacy Act (CCPA). Clients represent and warrant that they have the necessary rights, licenses, or permissions to use, upload, and distribute all Content on their hosted websites.
2. No Liability for Client Content
BizHost.co acts as a passive conduit for the storage and transmission of Client Content, as defined under Section 230 of the Communications Decency Act (47 U.S.C. § 230) and similar laws. BizHost.co shall not be liable for any claims, damages, losses, or liabilities arising from or related to Client Content, including but not limited to:
- Copyright or trademark infringement;
- Defamation, libel, or slander;
- Violations of privacy or data protection laws, including the CCPA;
- Illegal, offensive, or harmful content;
- Any other violation of third-party rights or applicable laws.
Clients agree to indemnify, defend, and hold harmless BizHost.co, its affiliates, officers, directors, employees, and agents from any claims, lawsuits, or liabilities (including reasonable attorneys’ fees) arising from their Content or use of BizHost.co’s services.
3. Copyright Infringement and DMCA Compliance
BizHost.co complies with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and has designated an agent to receive notifications of alleged copyright infringement. If BizHost.co receives a valid DMCA takedown notice or becomes aware of Content that allegedly infringes copyright, BizHost.co may, at its sole discretion, remove or disable access to the Content without prior notice to the Client. BizHost.co will promptly notify the Client of any such action and provide an opportunity to submit a counter-notification in accordance with the DMCA.

BizHost.co is not liable for any damages resulting from the removal or disabling of Content pursuant to a DMCA notice or other legal request. Clients are responsible for resolving any disputes related to copyright infringement directly with the complaining party.
4. No Active Monitoring of Content
BizHost.co does not actively monitor, review, or edit Client Content, nor is it obligated to do so under applicable law. BizHost.co will only take action to remove or disable access to Content if it receives actual knowledge of illegal activity (e.g., through a valid DMCA notice, court order, or credible complaint) or as required by law. Clients acknowledge that BizHost.co’s lack of monitoring does not imply endorsement or approval of their Content.
5. Compliance with California Law
As a California-based company, BizHost.co operates in accordance with California laws, including the CCPA, which governs the collection and use of personal information. Clients are responsible for ensuring that their Content and data practices comply with the CCPA and other applicable privacy laws. BizHost.co’s role is limited to providing hosting infrastructure and does not include responsibility for Client compliance with privacy or data protection obligations.
6. Limitation of Liability
To the fullest extent permitted by law, BizHost.co disclaims liability for any direct, indirect, incidental, consequential, or punitive damages arising from or related to Client Content or the use of BizHost.co’s services, including but not limited to damages for loss of profits, data, or business opportunities, even if BizHost.co has been advised of the possibility of such damages. This limitation applies to all claims, whether based on contract, tort, or any other legal theory, and is subject to California Civil Code § 1542, which provides:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
Clients expressly waive any rights under California Civil Code § 1542 or similar laws with respect to claims arising from this Disclaimer.
7. Termination and Removal of Content
BizHost.co reserves the right to suspend, terminate, or restrict access to any Client account or Content that violates these terms, applicable laws, or BizHost.co’s Acceptable Use Policy, with or without notice. BizHost.co may also remove or disable access to Content in response to complaints, legal orders, or at its sole discretion if it deems the Content to be unlawful or harmful.
8. Cooperation with Authorities
Upon receipt of a valid legal request (e.g., subpoena, court order, or law enforcement inquiry), BizHost.co may provide Client information or Content to the relevant authorities, as required by California or federal law. BizHost.co will cooperate with law enforcement to the extent necessary, but such cooperation does not imply liability or endorsement of Client Content.
9. Governing Law and Venue
This Disclaimer is governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from this Disclaimer or BizHost.co’s services shall be resolved exclusively in the state or federal courts located in San Diego County, California. Clients consent to the personal jurisdiction and venue of these courts.
